Indian Regulatory Framework for Crypto Assets & UDX Exchange Compliance Guidelines

1. Legal Status of Cryptocurrency in India
As per current guidelines from the Government of India and the Ministry of Finance, Virtual Digital Assets (Cryptocurrencies/Tokens) are legally recognized for holding and trading, but they are NOT recognized as Legal Tender in India. Only the Indian Rupee (INR) and Central Bank Digital Currency (e-Rupee) issued by the Reserve Bank of India (RBI) hold legal tender status.
2. Income Tax Guidelines & Taxation Framework (IT Act)
Under the Income Tax Act of India (Section 115BBH & Section 194S), virtual digital assets are subject to strict taxation policies:
- 30% Flat Income Tax: Profits generated from the transfer/sale of any virtual digital asset are subject to a flat 30% tax (plus applicable surcharge & cess).
- No Loss Set-off: Loss from the transfer of VDA cannot be set off against any other income or carried forward to subsequent years.
- 1% TDS Deduction: A 1% Tax Deducted at Source (TDS) is levied on the transfer/sale of crypto assets above prescribed thresholds to track financial transactions.
3. Anti-Money Laundering (AML) & FIU-IND Compliance
The Ministry of Finance has brought Virtual Digital Asset Service Providers (VDASPs) under the ambit of the Prevention of Money Laundering Act (PMLA), 2002:
- Mandatory Registration: Crypto exchanges and service entities operating in India or catering to Indian users are monitored by the Financial Intelligence Unit - India (FIU-IND).
- Mandatory KYC Verification: Know Your Customer (KYC) guidelines apply strictly to prevent illicit finance, identity fraud, and illegal transactions.
- Suspicious Activity Reporting: Entities are mandated to report suspicious transaction patterns to official regulatory bodies.
